GAP HEADNOTE SERIES – Austria (by KNOETZL)

On Thursday 22 February we helded an interactive discussion of the Austrian Supreme Court: Docket 24.3.2021, 3 Ob 2/21x (see here) in our ‘A Case in Time’ headnote series.

Florian Haugeneder and Patrizia Netal of KNOETZL, the authors of the GAP chapter on Austria, provided a discussion of the case study, followed by comments from Anzhela Torosyan, of Archipel (short bios of the speakers below) and a Q&A with the participants. Chatham House rules applied. The event chat was opened to facilitate networking and interaction.

ABOUT THE GAP AND THE SPEAKERS

The Delos Guide to Arbitration Places (GAP) is designed to assist in-house counsel, corporate lawyers and arbitration practitioners with efficiently accessing key insights into a large range of jurisdictions, including for the purposes of negotiating the choice of arbitral seats and conducting arbitral proceedings in those jurisdictions.

Florian Haugeneder is a partner at KNOETZL, a law firm specialized in arbitration, litigation, alternative dispute resolution, business crime, and corporate crisis management. Before co-founding KNOETZL in 2016, Florian was the head of the arbitration practice of an international law firm. Florian has extensive experience as counsel and arbitrator under the rules of the major arbitral institutions, including the ICC, ICSID, SCC, and VIAC, as well as in international and domestic ad-hoc arbitration such as UNCITRAL. He has successfully represented clients in some of the largest and most complex disputes in the CEE and SEE regions. A special focus of his practice is the international law on the protection of foreign investments under bilateral and multilateral investment protection treaties. Florian’s practice specializes in engineering and construction, energy, joint ventures, as well as commercial and corporate disputes. His experience includes numerous M&A projects, hotel management contracts, the construction and operation of a major fiber-optic cable infrastructure, a large IT outsourcing project, various thermal and hydro power plants, gas transportation and storage, banking and finance disputes, road and railway construction and rehabilitation and a sewer system. Florian has advised on a large number of FIDIC contracts. Florian was a board member of the Austrian Arbitration Association (ArbAut) from 2016 until 2020 and president of ArbAut from 2020 until 2022. He lectures at the University of Vienna and frequently speaks and publishes on international arbitration and investment protection. Who’s Who Legal has recognized him as a leading arbitration expert.

Patrizia Netal was a partner and arbitration expert in a dispute resolution boutique in Vienna before co-founding the firm KNOETZL in 2016. Patrizia practices both as counsel and arbitrator. She has extensive experience in institutional and ad-hoc arbitration proceedings (including the Rules of Arbitration of the International Chamber of Commerce (ICC), the Rules of Arbitration of the VIAC (Vienna Rules), the German Institution of Arbitration (DIS) and UNCITRAL Arbitration Rules). Her core practice is international commercial arbitration, focusing on construction and engineering, M&A projects, aviation, distribution and international sales disputes. Since September 2022, Patrizia is the vice-president of the VIAC (the Vienna International Arbitral Centre). She has served as a board member of VIAC since 2020. Patrizia is also the Co-Director of the Willem C. Vis International Commercial Arbitration Moot, the world’s largest and most renowned law student competition in the field of arbitration. Patrizia is co-author of the VIAC Handbook Vienna Rules, A Practitioner’s Guide (2019) and the Vienna Protocol. She was a member of the expert group working on the revision of the Vienna Rules 2021 (as well as on the Vienna Rules 2013 and 2018). Patrizia lectures arbitration at the Austrian Arbitration Academy. Patrizia is Austria’s steering committee member of the Pledge for Equal Representation in Arbitration.

Anzhela Torosyan, practices in international business litigation and enforcement of arbitral awards. Before joining Archipel as an associate in 2020, Anzhela trained with several law firms in Paris specialized in international arbitration, as well as worked as deputy counsel at the Secretariat of the ICC International Court of Arbitration in Paris. Admitted to Paris Bar, Anzhela holds a PhD and a Master’s degree in Public International Law from Paris-II Pantheon-Assas University as well as a Master’s degree in International Dispute Resolution from Paris-XII Creteil University and a degree in private law from Lomonosov Moscow State University in Russia. Anzhela speaks French, English, Russian and Armenian.
