GAP HEADNOTE SERIES – Germany (by CMS Hasche Sigle)

On Thursday 21 September at 3 pm CET (until 3.30 pm CET) took place an interactive discussion of the Key Features of the Planned Reform of German Arbitration Law, in our ‘A Case in Time’ headnote series.

Dr. Tilman Niedermaier and Marcus Weiler of CMS Hasche Sigle, the authors of the GAP chapter on Germany provided a discussion of the case study, followed by comments from Mark McMahon of STEWARTS (short bios of the speakers below) and a Q&A with the participants. Chatham House rules applied. The event chat was open to facilitate networking and interaction.

ABOUT THE GAP AND THE SPEAKERS

The Delos Guide to Arbitration Places (GAP) is designed to assist in-house counsel, corporate lawyers and arbitration practitioners with efficiently accessing key insights into a large range of jurisdictions, including for the purposes of negotiating the choice of arbitral seats and conducting arbitral proceedings in those jurisdictions.

Mark McMahon is an arbitration specialist, advising in international commercial and investor-state arbitrations. His practice is almost exclusively international and spans industries including construction, engineering, and energy. Mark has acted in disputes in multiple jurisdictions and has extensive experience in complex cross-border matters working on cases under all the major arbitration rules including ICC, LCIA, ICSID, and UNCITRAL. Mark is active in the international arbitration community, with a growing reputation amongst young practitioners. He is a committee member of the CiArb Young Member’s Group London Branch and is the Delos Guide to Arbitration Places (GAP) reviewer for Ireland. Mark is also a committee member of the Arbitration Ireland Young Practitioners Group and currently acts as an international mentor for the Istanbul Arbitration Centre.

Dr. Tilman Niedermaie represents clients in complex disputes before courts and arbitral tribunals. He is an expert in international procedural and contract law and focuses on corporate, commercial, and international investment disputes. Tilman advises on matters related to large-scale projects, distribution and procurement contracts, license and IP agreements, M&A contracts, and joint ventures in a variety of industry sectors (i.a. automotive, aerospace & defense, engineering, energy, infrastructure & transport, and sports). Tilman also acts as arbitrator. He joined CMS in 2010 and has been a partner since 2018. Before that, Tilman was a research fellow at the Institute of International Law of the Ludwig Maximilians University Munich and worked for a lawyer admitted to the German Federal Supreme Court. He is a lecturer at the Martin Luther University Halle-Wittenberg and the Ludwig Maximilians University Munich for international procedural and arbitration law.

Marcus Weiler acts as party representative and tribunal secretary in international arbitration proceedings. He advises on commercial and investor-state arbitrations, inter alia, about post-M&A disputes, Life Sciences and investment management. Marcus joined CMS in 2019.
