Delos appreciates that its users need to have predictability regarding the costs that may be required to resolve a dispute. The Delos procedure is designed to reduce these costs wherever possible.
Delos determines the costs of the arbitration based on the total value of the dispute and its expected complexity taking into account the seat of the arbitration (Article 14.2 of the Rules). The arbitration costs cover the fees and expenses of the Tribunal and the administrative costs of DELOS (Article 14.2 of the Rules). A filing fee of EUR 450 is to be paid by Claimant with its Notice of Arbitration: this amount is included in the costs of the arbitration.Â
Parties may benefit from a 5% reduction on the arbitration costs if they have sent their relevant contract(s) to Delos for registration within six months of signature of the contract(s), subject to the applicable floor (the reduction may not result in arbitration costs below the applicable floor).
