Delos-Y Roundtable – Comparative Law in Practice
Following the main programme (Three issues in comparative contract law), this dedicated roundtable invites associates to continue the conversation in a smaller, interactive setting designed specifically for younger practitioners. Building on the themes of good faith, contractual interpretation and change of circumstances, the session will move from theory to practice: How do these concepts arise in real cases? How should counsel frame them strategically? Where do comparative differences truly matter, and where do they converge? Facilitated by Monika Diehl, Vivek Kapoor and Gustavo Moser, the discussion is designed to be participatory and informal. The aim is to create a space in which associates can engage confidently with complex comparative concepts, connect with peers, and develop a stronger sense of agency ... Read More

Monetizing the Award: The Emergence of Secondary Markets and ‘Award Flip’ Strategies
This event marks the shift of an arbitral award from a ‘legal victory’ to a tradable financial asset in international arbitration. Unlike general funding panels, this session focuses on the exit strategy: what happens when the claimant doesn’t want to wait 3–5 years for enforcement and instead wants to “flip” the award to a specialized fund for immediate cash. Undoubtedly, the new frontier in Third-party funding arrangements is the secondary market for arbitral awards, where funds buy the award outright at a discount before it is even enforced.• Why it’s unique: It treats an arbitral award as a financial commodity rather than just a legal victory.• Practice-Oriented Focus:o How to structure a ‘partial sale’ of an award to manage litigation ... Social and environmental issues in mining arbitration
Mining disputes now sit at the intersection of investment protection, environmental regulation, and social legitimacy. Issues such as the social licence to operate, environmental permitting, community opposition, and ESG-driven regulation are no longer peripheral — they are central to how tribunals assess jurisdiction, treaty breaches, and damages. Yet these issues are often addressed inconsistently and without a structured analytical framework. This conference aims to fill that gap. The proposed conference would provide a focused and timely forum to examine how social and environmental factors are treated across the different stages of arbitral analysis. It would be of direct interest to arbitrators, counsel, States, investors, experts, and academics dealing with mining and natural resources disputes. Register here.
