Mediation in International Disputes: Emerging Practice in Commercial and Investor-State Contexts
Young ICCA held an in-person discussion on mediation in international dispute resolution during Paris Arbitration Week on Tuesday 24 March. Bringing together experienced mediators, counsel, and representatives of arbitral institutions, the session explored how mediation is increasingly used alongside or instead of other dispute resolution methods in both investor–state and commercial disputes. The discussion addressed emerging procedural frameworks, institutional initiatives, enforceability, and strategic considerations that shape when and how parties deploy mediation in complex cross-border conflicts.
The speakers included Karim M’ziani, Bill Marsh, Sylvia Noury KC, Chahinez Ouali and Paul Sills. Vincent Carriou, Michael Greenop, Nika Rassadina and Katrine Tvede moderated the discussion.
