STARTING A DELOS ARBITRATION

To start a DELOS arbitration, please complete the model Notice of Arbitration found at Appendix 1 of the Rules of Arbitration (the "Rules"). This model sets out in detail what information you should aim to provide.

Once your Notice of Arbitration and supporting documents are ready, please send everything:

  • to the respondent(s), to their e-mail address specified in the contract, or have everything delivered to their address or place of business. If you want to be cautious, you should (also) courier the documents to (each of) the respondent(s). You should make sure to obtain and keep evidence of having delivered the Notice of Arbitration (see Article 3 of the Rules); and
  • to Delos, at secretariat@delosdr.org.

You also need to pay the Filing Fee of EUR 450. You can do so by way of bank transfer to the bank details set out below or by credit card here (plus credit card charges):

Upon receipt of the Filing Fee, Delos will provide you with a payment receipt, which you can then send to the respondent(s).

The arbitration commences on the date that Delos receives the Notice of Arbitration. The time-limit for the respondent(s) to answer the Notice of Arbitration begins from the first business day at the residence or place of business of respondent(s) following the date of commencement of the arbitration and (deemed) receipt by respondent(s) of the Notice of Arbitration and of the Filing Fee payment proof, whichever is latest.
