SUMMARY:GAP HEADNOTE SERIES – China (by Herbert Smith Freehills)
DESCRIPTION:\nOn Thursday 2 March took place an interactive discussion of the PRC Supreme Court’s recent guidance on issues relating to determining the validity of arbitration agreements, in our ‘A Case in Time’ headnote series.\n\n\n\nHelen Tang and Celine Wang of Herbert Smith Freehills, the authors of the GAP chapter on China, summarised the issues relating to determining the validity of arbitration agreements. They shared the key takeaways based on the PRC Supreme Court’s recent effort to provide a uniform approach for courts across the country to follow in dealing with these issues and discuss two guiding cases published by the PRC Supreme Court in December 2022, followed by comments from Isuru Devendra of Latham & Watkins (short bios of the speakers below) and a Q&A with the participants. Chatham House rules applied. The event chat was opened to facilitate networking and interaction.\n\n\n\nYou could submit advance questions to the speaker to address to event@delosdr.org; you can find out more about Delos’s Guide to Arbitration Places (GAP) here, and sign up for GAP news here; and do look up other forthcoming events in our Headnote ( https://delosdr.org/a-case-in-time/gap-headnote-series/ ) and Journal ( https://delosdr.org/a-case-in-time/gap-journal-series-a-case-in-time/ ) Series.\n\n\n\nThe recording is available here.\n\n\n\nYou can find out more about Delos’s Guide to Arbitration Places (GAP) here ( https://clicks.aweber.com/y/ct/?l=7.5Q0&m=8qwvq9yu0NAJxKlc&b=IEveVsX7kU1dFJwvSK7fNA ), and sign up for GAP news here ( https://clicks.aweber.com/y/ct/?l=7.5Q0&m=8qwvq9yu0NAJxKlc&b=fYinf2w.Pvr.OwOnCBCPwQ ), and do look up other forthcoming events in our Headnote ( https://delosdr.org/a-case-in-time/gap-headnote-series/ ) and Journal ( https://delosdr.org/a-case-in-time/gap-journal-series-a-case-in-time/ ) Series.\n\n\n\nABOUT THE GAP AND THE SPEAKERS\n\n\n\nThe Delos Guide to Arbitration Places (GAP) is designed to assist in-house counsel, corporate lawyers and arbitration practitioners with efficiently accessing key insights into a large range of jurisdictions, including for the purposes of negotiating the choice of arbitral seats and conducting arbitral proceedings in those jurisdictions.\n\n\n\nThis peer-reviewed open access publication is now in its second edition.
